गृहमंत्री अमित शाह का राज्यसभा में बयान कहा कश्मीर से हटाई जाएगी धारा 370 । धारा 370 क्या है , भारतीय संविधान के अनुच्छेद के तहत कश्मीर को एक विशेष राज्य का दर्जा प्राप्त है , जिसके अनुसार केंद्र सरकार कि कोई भी योजना बिना राज्य सरकार की सहमति से राज्य में लागू नहीं किया सकती और यह अनुच्छेद जम्मू एंड कश्मीर राज्यपाल अपना अलग संविधान बनाने की भी शक्ति देता है यहां के मुख्यमंत्री का पद किस राज्य के लिए प्रधानमंत्री के पद के बराबर होता है अर्थात राजा सरकार की अनुमति के बिना कश्मीर में केंद्र सरकार की कोई भी योजना लागू नहीं की जा सकती है धारा 370 कश्मीर को अपना अलग झंडा रखने की भी अनुमति देती है । संविधान के अनुच्छेद 370 के तहत जम्मू कश्मीर राज्य में आंतरिक कलह के नाम पर आपातकालीन स्थिति की घोषणा नहीं की जा सकती है और ना ही यहां पर केंद्र सरकार बिना राज्य सरकार की अनुमति के भारत की सशस्त्र सीमा और को भेज सकती है, जम्मू एंड कश्मीर राज्य में सशस्त्र बलों की तैनाती अफस्पा एक्ट के तहत की जाती है ।
